Your Questions Answered

Does it matter if I have no symptoms or only mild symptoms?

No. As stated above, we can help whatever complications you have experienced – even if you have no obvious symptoms and are simply concerned that you have had a mesh implant fitted.

I understand there has already been a settlement made with mesh survivors. How does this affect me?

In 2020 Johnson and Johnson subsidiary, Ethicon (one of the major manufacturers of mesh implants), agreed a settlement with Scottish mesh survivors who received one of their implants. If you were not involved in this settlement you should still get in contact – you may still be entitled to compensation.

What level of compensation might I receive?

It is impossible to answer this question at the outset of a claim, as it is dependent on so many inter-linked factors, including the severity of your symptoms (and whether they have long-lasting impacts) and the nature of the losses you have suffered (including medical costs and lost earnings – both past and future).

You may be entitled to financial compensation for all of the ways in which you have suffered loss as a result of your vaginal mesh surgery. If your claim is successful, you could be awarded damages for your injury, the cost of the original treatment and the cost of any corrective measures. Our team will ensure that you have all the evidence required to support your claim.

Once we have made an initial assessment of your case, we will be able to give you a rough indication of what we would expect to achieve. See our article, ‘More Than Just Personal Injury’, which provides full details on the losses you can claim for.

Does it matter which manufacturer made the mesh that I’ve been fitted with?

No. There are a number of manufacturers who have produced transvaginal mesh implants. You may still be entitled to compensation regardless of who manufactured the mesh used in your treatment. You don’t have to know the manufacturer when you contact us – we will be able to find out this information for you.

How long will it take?

In an ideal world, your claim would be resolved within weeks but, unfortunately, the reality is that the length of time it takes for claims to conclude can range from months to years. The timings will depend on the complexity of the case and the severity of your injuries. Particularly in cases where injuries are serious, it is important to take the time to collect all necessary information and to establish the true value of the claim.

What will it cost?

For all personal injury and medical negligence work, we provide a no-win, no-fee service, which is exactly as it says – if your claim is successful our fee is 20% plus VAT of your settlement figure; however, if your claim is not successful we do not charge a fee.

Will I have to go to court?

In most cases, personal injury claims can be settled without the need to go to court and we will endeavour to get an out-of-court settlement for your vaginal mesh claim. Where a court action needs to be raised we will still endeavour to get an out-of-court settlement for your vaginal mesh claim. Around 95% of personal injury cases settle without going before a judge. However, in a small number of cases it may be necessary to go to court. If you have to go to court we will represent you and provide you with all the support and advice you will need.

What is the time limit for bringing a claim for vaginal mesh surgery?

The normal time limit for bringing a claim for vaginal mesh surgery is three years from the date you became aware that your symptoms are caused by your mesh implant. In some circumstances, this time limit may be extended.
