UK Supreme Court Sits in Glasgow: Our Trainees’ Perspective

Last week marked a significant moment for the Scottish legal community, as the UK Supreme Court sat in Glasgow for the first time. To mark the occasion, we sent our trainee solicitors along throughout the week to observe proceedings first-hand.

Across a range of appeals, including ScottishPower v HMRC and Forthwell Limited v Pontegadea UK Limited, our trainees gained a rare insight into appellate advocacy at the highest level.

A consistent theme across their observations was the intensity of judicial engagement and the importance of clear, responsive advocacy under scrutiny. This came through clearly in the following reflections from our trainees:

“I was especially struck by the frequency and depth of judicial interventions, which clearly influenced the direction and pace of the submissions. It also highlighted the importance of responding concisely and persuasively under sustained questioning.” Robyn Linich

“Counsel were questioned closely on the consequences of each proposed interpretation, as well as the wider policy implications of their arguments… it was particularly impressive how confidently and effectively counsel responded to such sustained scrutiny.” Jason Wood

The hearings also highlighted the precision required in appellate litigation, with a strong focus on statutory interpretation, contractual wording, and the characterisation of legal issues.

“The appeal concerned whether substantial ‘redress payments’… could be deducted for corporation tax purposes… whether the court should look at the legal form of a payment or its practical substance.” Jason Wood

“There was a clear emphasis on the precise interpretation of legislation, case law and even the individual wording used in evidence documents.” Angela Wilson

For trainees coming from a variety of practice areas, the experience offered a valuable perspective on how legal principles operate across disciplines.

“As a Trainee Solicitor that deals with personal injury, it was fascinating to see how a breach of contract appeal focused on precise wording, legal principles and the losses incurred are defined.” Fatmata Wurie

“It provided a valuable opportunity to observe how complex statutory protections are interpreted and applied at the highest level.” Jenna Thorpe

“The appeals provided an insightful look into the ongoing development of whistleblowing law and the interpretation of statutory protections for employees.” Adele Muir

The structure and delivery of submissions also stood out, particularly the importance of clarity and technique in presenting complex arguments.

“I was particularly impressed by both advocates’ use of clear signposting throughout their submissions, which highlighted how important that technique is in helping the court follow complex arguments.” Ben Tuddenham

“Counsel presented clear and confident submissions, engaging closely with judicial questioning while navigating complex statutory provisions and authorities.” Angela Wilson

Alongside the technical excellence on display, trainees also reflected on the professionalism and advocacy style of those appearing before the court.

“They handled every question with confidence and control, their composure under pressure reminded me how important clear thinking, steady communication and confidence are.” Fatmata Wurie

“The Appellant and Respondent delivered seamless arguments that were both thought provoking and persuasive.” Lucie Clark

Lucie also captured the significance of the occasion itself:

At the end of the hearing, Lord Reed addressed the court, the lawyers, and the lay persons in attendance. With no hesitation he made it clear that we were watching the law change and develop before our eyes; this case stood with fundamental importance, and I was witness to it.” Lucie Clark

For our trainees, the opportunity to attend the Supreme Court in Glasgow was not only a valuable learning experience, but a memorable one. Observing how complex legal issues are argued and tested at the highest level provides insight that simply cannot be replicated elsewhere.
