Area of Law: Residential Lettings / Housing
Location: Scotland
Outcome: Tenant vacated property following prolonged non‑payment of rent
The Background
Our client, a private landlord, sought legal assistance following a prolonged period of rent arrears by their tenant. The landlord also wanted to sell the property. Despite attempts to resolve the situation amicably, the tenant ceased paying rent altogether, leaving the landlord with ongoing financial loss and uncertainty.
The eviction process began in 2024 and quickly proved to be more complex and protracted than anticipated, involving procedural challenges and multiple developments before resolution could be achieved.
The Legal Challenge
Residential eviction proceedings in Scotland can be particularly intricate, especially where matters are contested or subject to changes during the process. In this case, the eviction required careful navigation of tribunal procedures, strict compliance with statutory requirements, and a strategic approach to responding to unexpected twists along the way.
The client required clear advice, consistent support, and proactive representation to ensure the matter progressed efficiently while minimising additional stress and risk.
Our Approach
Jackson Boyd provided ongoing advice and representation throughout the eviction process. From the outset we offered pragmatic and sensible guidance, ensuring the client understood both the legal framework and the practical realities of tribunal proceedings.
The case was managed proactively, with high‑quality written and oral submissions to the First‑tier Tribunal for Scotland (Housing and Property Chamber). Regular communication ensured the client remained informed at each stage, and any new developments were addressed swiftly and effectively.
The Outcome
Following a lengthy process, the tenant vacated the property in March 2026. The client was able to regain possession of the property and move forward with confidence, supported throughout by clear advice and robust legal representation.

I would highly recommend both Tony and Jackson Boyd.”
